Good question Dave. I didn't read anything about the redaction of the 2499lt/yr allowance. That's not to say it's not in that document somewhere!!!!!!!!!!!!

All mention of Biodiesel in that form and "road use" only ever refers to it as "Rebated Biodiesel" .As we don't make, purchase or use Rebated Biodiesel, I'm taking it for now that we are still exempt unless as already mentioned they specifically state that our 2499L production exemption is retracted too.
I can understand why the Government would make this move, it hits all of the correct targets for climate and at the same time returns them a significant increase in tax, but like always there will be some groups like ours that will inadvertently have to cease.

I'm assuming they never even considered us.
Think of all those millions of litre of waste oil that will now go down the drain!
If they do remove our allowance, It will be the and of an era and I suppose my large family cruiser will have to go :-(

Has anyone e-mailed Priti Khatri at HMRC mentioned at the bottom, no point in guessing may as well ask?

I have just been reading the HMRC  Biofuel notice 179e on the HMRC website. This is the form that sets out how we are exempt producers of Biodiesel (as long as meet the requirements 2500 litrs etc)

It was published in 2014 and the only update since it's introduction was in Jan 2021 and is only a sidenote referencing a small change due to leaving the EU.

I would like to think that if they were going to repeal amend or reverse notice 179e it would already have been on their website. However having dealt with the HMRC over the last 30 years i can say that they are one of the most unorganised organisations (Oxymoron)I have ever known.
Either way until that notice 179e is amended  and makes it clear our entitlement has changed or removed I'm sure that would be sufficient evidence to allow us to continue our operations legally until it is.

That's a very good point made by Tony. 179e is a very specific document/exemption. The status quo must be being maintained because it wasn't mentioned.
That being said though...the government could U turn it at any point. Let's hope they don't.
